City of Oshkosh-Minutes & Budget Hearing September 2024
The City of Oshkosh Council met for Budget Hearing September 12, 2024, at 5:00 p.m.
In compliance with the Open Meetings Act of Nebraska, a current copy of the act is posted in the Council Chambers. Notice of this meeting was advertised in the Garden County News and posted at the Oshkosh Post Office, City Hall and Courthouse. The agenda for this meeting was kept current and available for inspection at City Hall.
Mayor Davis called the meeting to order and read the Open Meetings Act, LV 898.
Present: Mayor, Terry Davis & Council Members: Mike Piva, George Zoucha, Gary DeCock & Jaden Porter. Also attending: Administrator James Bondegard, Deputy Clerk Kim Martin, City Attorney Rory Roundtree, Sheriff Randy Ross, Erica Busch with WCNDD, Library Director Brittany Waltman, Trevor Schuessler with Rauner &Assoc., Tina Sullivan, Allen & Sally Anderson, Jo Lynn & Jim Blackwell, & Tom Martin.
Mayor Davis opened the Budget Hearing at 5:00 p.m. Trevor Schuessler handed out summarized budget. Schuessler discussed the budget with the council. Mayor Davis asked for public comment concerning the proposed budget. No person spoke in favor or against the proposed budget.
Mayor Davis closed the budget hearing at 5:08 p.m.
Mayor Davis opened the Levy hearing at 5:08 p.m.
Motioned by Piva, seconded by Zoucha, to adopt the proposed budget for 2024-2025. Motion carried unanimously.
Motioned by Piva, seconded by DeCock, to set levies at a different amount than prior year tax request. Motion carried unanimously.
Motioned by Zoucha, seconded by Porter, to Approve Resolution 44-24. Motion carried unanimously.
RESOLUTION NO. 44-24
WHEREAS, Nebraska Revised Statute 77-1632 and 77-1633 provides that the Governing Body of the City of Oshkosh passes by a majority vote a resolution or ordinance setting the tax request; and
WHEREAS, a special public hearing was held as required by law to hear and consider comments concerning the property tax request;
NOW, THEREFORE, the Governing Body of the City of Oshkosh resolves that:
1. The 2024-2025 property tax request be set at:
General Fund: $73,540.28
Bond Fund: $53,200.00

$126,740.28
2. The total assessed value of property differs from last year’s total assessed value by 15.24 percent.
3. The tax rate which would levy the same amount of property taxes as last year, when multiplied by the new total assessed value of property would be 0.277167 per $100 of assessed value.
4. The City of Oshkosh proposes to adopt a property tax request that will cause its tax rate to be 0.290223 per $100 of assessed value.
5. Based on the proposed property tax request and changes in other revenue, the total operating budget of the City of Oshkosh will increase (or decrease) last year’s budget by -100 percent.
6. A copy of this resolution be certified and forwarded to the County Clerk on or before October 15, 2024.

Broadband: Vistabeam is bringing in supplies to get started.
Discussed Ordinance Integration with Attorney.
NEW BUSINESS:
Erica Busch, representing WCNDD gave a presentation on nuisance properties. Motion by Zoucha, seconded by Piva to Rescind by Resolution No. 39-24, 40-24, 41-21, & 42-24. Full Resolutions are on file at City Hall.
Motion by Zoucha, seconded by Piva to Abate 2024 OSH 040-1106 W 3rd. Motion carried unanimously.
Sherriff Randy Ross presented the Sheriff’s report.
Animal Control report was reviewed.
Library Director Brittany Waltman reviewed the library report with Council.
Motion by Zoucha, seconded by Porter to approve Randy Jensen’s building permit at 111 E Ave F. Motion carried unanimously.
Motion by Zoucha, seconded by Piva to approve SDL for FOE for a private event on October 12, 2024. Motion carried unanimously.
Motion by Zoucha, seconded by Porter to approve SDL for FOE for Pheasants Forever Banquet. Motion carried unanimously.
Motion by Porter, seconded by Piva to approve the Right of Way agreement with Vistabeam for Construction for Fiber Project. Motion carried unanimously.
Motion by DeCock, seconded by Piva to approve the Construction permit. Motion carried unanimously.
Motion by Piva, seconded by Zoucha to approve the Recodification agreement with American Legal Publishing. Motion carried unanimously.
Motion by Zoucha, seconded by Porter to approve Miller & Associates proposal from Preliminary Provision report for sewer collection repairs. Motion carried unanimously.
Motion by Porter, seconded by Zoucha to approve Resolution No. 43-24: Municipal Certification of Program Compliance. Motion carried unanimously.
RESOLUTION NO. 43-24
WHEREAS: State of Nebraska Statutes, sections 39-2115, 39-2119, 39-2120, 39-2121, and 39-2520(2), requires an annual certification program compliance to the Nebraska Board of Public Roads Classifications and Standards. Full Resolution on file at city hall for public reading.
