City of Oshkosh-Minutes-August 2024
The City of Oshkosh Council met for regular session August 8, 2024, at 5:00 p.m.
In compliance with the Open Meetings Act of Nebraska, a current copy of the act is posted in the Council Chambers. Notice of this meeting was advertised in the Garden County News and posted at the Oshkosh Post Office, City Hall and Courthouse. The agenda for this meeting was kept current and available for inspection at City Hall.
Mayor Davis called the meeting to order and read the Open Meetings Act, LV 898.
Present: Mayor, Terry Davis & Council Members: Mike Piva, George Zoucha. Absent: Council Member Gary DeCock & Jaden Porter. OLD BUSINESS:
ARPA Funds: Updated Council on financials and completion of new Library Carpet.
Broadband: Drew with Vistabeam gave an update on the project. The plan to install arial cannot be completed so they plan to do an underground design. The December deadline is still planned. Discussed right away agreements for construction of fiber project.
NEW BUSINESS:

Sheriff Report was reviewed.
The Animal Control Report was reviewed.
Trevor with Rauner & Assoc. reviewed the budget with Council. Gave status on Levy Request and advised that the City is in a good situation with cash reserves for the Budget. Trevor will be finalizing the budget by September Council meeting.
Blake Stegman discussed with Council about a possible Carport at 300 W Ave L. Council discussed in length on the regulations.
Motion by Zoucha seconded by Piva to approve Randy Jensen’s building permit at 111 E Ave F. AYE: Piva, Zoucha, Davis. Voting NO: None. Motion carried.
Motion by Piva seconded by Zoucha to approve Economic Development recommendation of a 7-year new business loan of $30,000 for Jordan Russell to purchase Heartland Lumber. Voting AYE: Piva, Zoucha, Davis. Voting NO: None. Motion carried.
Bondegard discussed a Grant application for future Water System GIS mapping project with the Council.

RESOLUTION NO. 38-24
WHEREAS, the City of Oshkosh, Nebraska currently imposes a municipal sales and use tax, pursuant to Neb. Rev. Stat. §18-2701 et. seq., of two percent (2%) as provided for by Nebraska law; and
WHEREAS, the City of Oshkosh, Nebraska currently has in place and Economic Development Plan, approved by the voters, that will expire September 30, 2025;
WHEREAS, one-half percent (1/2%) of the current sales tax, authorized by LB840, and approved by the voters, will expire June 30, 2025;
WHEREAS, LB 840 provides that continuation of its municipal sales and use tax and Economic Development Plan pursuant to the law shall submit the question at an election to the voters; and
WHEREAS, the question of the continuation of such sales and tax use tax shall be submitted upon the affirmative vote by at least seventy percent of all members of the governing body of the governing body of the incorporated municipality; and
WHEREAS, any proceeds from an approved sales and use tax shall be used for economic development pursuant to the approved Economic Development Plan of the City of Oshkosh.
NOW THEREFORE, BE IT RESOLVED BY THE MAYOR AND CITY COUNCIL OF THE CITY OF OSHKOSH, NEBRASKA, that:
The City of Oshkosh shall submit to the registered voters of the City of Oshkosh, Nebraska the question to of continuation of the current one-half (½%) and continuation of the current Economic Development Plan on the ballot at the November 5, 2024 general election in substantially the same form as the Sample Ballot marked as “Exhibit A” attached hereto and by this reference is hereby made a part of this Resolution.
Any Resolutions in conflict with this resolution are hereby repealed.
PASSED AND APPROVED this 8th day of August, 2024.
