City of Oshkosh Minutes-April 2025

​The City of Oshkosh Council met for regular session April 10th, 2025, at 5:00 p.m.
 
In compliance with the Open Meetings Act of Nebraska, a current copy of the act is posted in the Council Chambers.  Notice of this meeting was advertised in the Garden County News and posted at the Oshkosh Post Office, City Hall and Courthouse. The agenda for this meeting was kept current and available for inspection at City Hall.
 
Mayor Terry Davis called the meeting to order and read the Open Meetings Act, LV 898.
 
Present: Mayor Terry Davis, Council Members: Mike Piva, Gary DeCock, and Jeannie Schwartz. Also attending: City Attorney Rory Roundtree, City Administrator James Bondegard, Deputy Clerk Kim Martin, Jerry Smith, Laurie Soper, Joe McGinley, Whitney Rothwell, Sally Anderson, Vicente and Kelli Rodarte, and Sheriff, Randy Ross. Absent: council member Jaden Porter.
 
Motion by Piva, seconded by Schwartz to excuse Jaden Porter. Motion carried unanimously.
 
Motion by DeCock, seconded by Piva to approve the consent agenda: agenda, minutes, claims, Treasurer’s Report.  Motion carried unanimously.

ARPA Funds: Updated on financials.
 
Broadband: Installations are being scheduled.
 
Update on Good Sports grant: Bondegard updated council on equipment received.
 
NEW BUSINESS:
 
The Animal Control Report was reviewed.
 
Sheriff Ross gave Sheriff’s Report.
 
Motion by Piva, seconded be Schwartz to approve Economic Development Committees Recommendation for LB840 loan to Main Street Medical. Motion carried unanimously.
 
Motion by DeCock, seconded by Piva to approve Economic Development Recommendation for LB840 loan for Flag Aviation. Motion carried unanimously.
 
Motion by Piva, seconded by Schwartz to approve proposal from PADD for updated Comprehensive Plan. Motion carried unanimously.
 
Motion by Piva, seconded by DeCock to approve proposal from PADD for Blight Study. Motion carried unanimously.
 
Motion by Piva, seconded by Schwartz to approve May 8th for annual clean up day and May 15th as an alternative. Motion carried unanimously.
 
Motion by Piva, seconded by DeCock to Suspend the statutory rules requiring ordinances to be read  by title on three different days to be suspended and that Ordinance No. 484 be considered on same day upon reading by number and placed on final passage. Motion carried unanimously.
 
Motion by Piva, seconded by Schwartz to approve Ordinance No. 484. Motion carried unanimously.
 
 
CITY OF OSHKOSH
ORDINANCE NO. 484
 
AN ORDINANCE OF THE CITY OF OSHKOSH, GARDEN COUNTY, NEBRASKA, TO AMENDING ARTICLE 5-5: ANIMALS, OF THE CITY CODE BOOK; TO PROVIDE THAT THE PROVISIONS OF THIS ORDINANCE SHALL BE MADE A PART OF THE CODE OF THE CITY OF OSHKOSH; AND PROVIDE WHEN THIS ORDINANCE SHALL BE IN FULL FORCE AND EFFECT. Full Ordinance is on file at City Hall.
 
BE IT ORDAINED BY THE MAYOR AND THE CITY COUNCIL OF THE CITY OF OSHKOSH, NEBRASKA: 
 
Joe McGinley discussed with council the need of a weather station at the airport.
 
Motion by DeCock, seconded by Schwartz to approve Oshkosh Water Tower SDL for celebration in July, Abstained: Piva. Voting AYE: DeCock, Schwartz, and Davis.
 
Motion by Schwartz, seconded by DeCock to approve SDL for Oshkosh Water Tower for BRAN event. Abstained: Piva. Voting AYE: DeCock, Schwartz, and Davis.
 
Motion by Piva, seconded by DeCock to approve Resolution NO. 30-25 for new sanitation rates. Motion carried unanimously.
RESOLUTION NO. 03-25
 
RESOLUTION ESTABLISHING SANITATION RATES
 
WHEREAS, the Mayor and Council of the City of Oshkosh, Nebraska (“City” or “Governing Body”), on this 10 day of April 2025, hereby resolves as follows:
 
WHEREAS, the City Code, § 3-3.4 RATES establishes that the Governing Body may, by resolution, establish rates for all property upon which any building has been or may be erected having a connection with any lines or pipes which are or may be construed and used in connection with the city sewer system; and
 
WHEREAS, the fees associated with waste collection and disposal have increased thereby necessitating an increase in rates.
 
NOW THEREFORE, the City hereby establishes rates for waste sanitation as follows:
 
Residential per Month:
     Residential Customer                                                                                                                  $22.00
     Residential Customer Senior                                                                                              $18.75
     Churches                                                                                                                               $18.75
 
Commercial per Month:
 96 gallon weekly pickup                                                                                                             $27.00
 1.5 yd weekly pickup                                                                                                                  $40.25
  3 yd weekly pickup                                                                                                                    $77.25
   3 yd twice weekly pickup                                                                                                                   $105.00
 
Passed, approved and adopted on this 10th day of APRIL 2025.     
 
Bondegard discussed with council options for fundraisers for repairs needed at the auditorium.
 
Motion by Piva, seconded by DeCock to approve changes to the updated employee handbook. Motion carried unanimously.
 
Motion by Piva, seconded by Schwartz to approve the sale of the 1959 dump truck. Sealed bids can be dropped off at City Hall. Bids will be opened at the May 8th meeting at 5:15 P.M. Motion carried unanimously.
 
Motion by Schwartz, seconded by DeCock to approve the use of Keno funds to purchase two picnic tables for the baseball field/park. Motion carried unanimously.
 
Vicente and Kelli Rodarte updated council on site plans.
 
Motioned by Piva, seconded by Schwartz to approve building permits for new construction at 203 W Ave A. Abstain: DeCock. Voting AYE: Piva, Schwartz, and Davis.
 
Bondegard discussed with council the annual Audit report which has been submitted to the State.
 
On agenda item 20 city attorney discussed with council updates and next steps to be taken in regard to delinquent LB840 loan. Auditor is seeking a resolution with this matter.
 
Motion by Piva, seconded by DeCock to adjourn the meeting at 6:19 P.M. Motion carried unanimously.
