The City of Oshkosh Council met for regular session September 11th , 2025, at 5:00 p.m.
In compliance with the Open Meetings Act of Nebraska, a current copy of the act is posted in the Council Chambers. Notice of this meeting was advertised in the Garden County News and posted at the Oshkosh Post Office, City Hall and Courthouse. The agenda for this meeting was kept current and available for inspection at City Hall.
Mayor Terry Davis called the meeting to order and read the Open Meetings Act, LV 898.

WCNDD: Consider A Motion to Rescind Resolution.
Motioned by Porter, seconded by DeCock to Rescind Resolution. Motion carried unanimously. Full Resolutions are on file at City Hall.
Sheriff Randy Ross discussed with council the Sheriff’s report.
The Animal Control Report was reviewed.
Motion by Porter, seconded by DeCock to approve the building permit for a covered shop at 5868 Rd 181. Motion carried unanimously.
Motion by Porter, seconded by Schwartz to approve building permit for a storage/ workshop at 402 W 5th. Motion carried unanimously.
Motion by DeCock, seconded by Porter to approve the Interlocal Agreement with the Garden County EMS service Motion carried unanimously.
Motioned by Schwartz, seconded by Porter to approve the Bishop Business proposal to digitize records for the city. Motion carried unanimously.
Motion by Piva, seconded by Porter to Suspend the statutory rules requiring ordinances to be read by title on three different days to be suspended and that Ordinance No.485 be considered on same day upon reading by number and placed on final passage. Motion carried unanimously.

ORDINANCE NO. 485
AN ORDINANCE ENACTING A CODE OF ORDINANCES FOR THE CITY OF OSHKOSH,
NEBRASKA REVISING, AMENDING, RESTATING, CODIFYING AND COMPILING CERTAIN
EXISTING GENERAL ORDINANCES OF THE POLITICAL SUBDIVISION DEALING WITH
SUBJECTS EMBRACED IN SUCH CODE OF ORDINANCES, AND DECLARING AN
EMERGENCY.
WHEREAS, the present general and permanent ordinances of the political subdivision are inadequately
arranged and classified and are insufficient in form and substance for the complete preservation of the
public peace, health, safety and general welfare of the municipality and for the proper conduct of its
affairs; and
WHEREAS, the Acts of the Legislature of the State of Nebraska empower and authorize the political
subdivision to revise, amend, restate, codify and compile any existing ordinances and all new
ordinances not heretofore adopted or published and to incorporate such ordinances into one ordinance
in book form; and
WHEREAS, the Legislative Authority of the Political Subdivision has authorized a general
compilation, revision and codification of the ordinances of the Political Subdivision of a general and
permanent nature and publication of such ordinance in book form; and
WHEREAS, it is necessary to provide for the usual daily operation of the municipality and for the
immediate preservation of the public peace, health, safety and general welfare of the municipality that
this ordinance take effect at an early date.
NOW, THEREFORE, BE IT ORDAINED BY THE LEGISLATIVE AUTHORITY OF THE CITY OF
OSHKOSH, NEBRASKA
SECTION 1.
The general ordinances of the Political Subdivision as revised, amended, restated, codified, and
compiled in book form are hereby adopted as and shall constitute the “Code of Ordinances of the City
of Oshkosh, Nebraska.”
SECTION 2.
Such Code of Ordinances as adopted in Section 1 shall consist of the following Titles:
TITLE I: GENERAL PROVISIONS
TITLE III: ADMINISTRATION
TITLE V: PUBLIC WORKS
TITLE VII: TRAFFIC CODE
TITLE IX: GENERAL REGULATIONS
TITLE XI: BUSINESS REGULATIONS
TITLE XIII: GENERAL OFFENSES
TITLE XV: LAND USAGE
PARALLEL REFERENCES
SECTION 3.
All prior ordinances pertaining to the subjects treated in such Code of Ordinances shall be deemed
repealed from and after the effective date of this ordinance except as they are included and reordained in
whole or in part in such Code; provided, such repeal shall not affect any offense committed or penalty
incurred or any right established prior to the effective date of this ordinance, nor shall such repeal affect
the provisions of ordinances levying taxes, appropriating money, annexing or detaching territory,
establishing franchises, or granting special rights to certain persons, authorizing public improvements,
authorizing the issuance of bonds or borrowing of money, authorizing the purchase or sale of real or
personal property, granting or accepting easements, plat or dedication of land to public use, vacating or
setting the boundaries of streets or other public places; nor shall such repeal affect any other ordinance
of a temporary or special nature or pertaining to subjects not contained in or covered by the Code.
SECTION 4.
Such Code shall be deemed published as of the day of its adoption and approval by the Legislative
Authority and the Clerk of the Political Subdivision is hereby authorized and ordered to file a copy of
such Code of Ordinances in the Office of the Clerk.
SECTION 5.
Such Code shall be in full force and effect as provided in Section 6, and such Code shall be
presumptive evidence in all courts and places of the ordinance and all provisions, sections, penalties
and regulations therein contained and of the date of passage, and that the same is properly signed,
attested, recorded, and approved and that any public hearings and notices thereof as required by law
have been given.
SECTION 6.
This ordinance is declared to be an emergency measure necessary for the immediate preservation of the
peace, health, safety and general welfare of the people of this municipality, and shall take effect at the
earliest date provided by law.
This ordinance shall be in full force and effect from and after its passage, approval and publication
according to law.

AN ORDINANCE OF THE CITY OF OSHKOSH, GARDEN COUNTY, NEBRASKA,
AMENDING § 73-17 LICENSE OR PERMIT REQUIRED, OF THE CITY CODE
BOOK; TO PROVIDE THAT THE PROVISIONS OF THIS ORDINANCE SHALL BE
MADE A PART OF THE CODE OF THE CITY OF OSHKOSH; AND PROVIDE WHEN
THIS ORDINANCE SHALL BE IN FULL FORCE AND EFFECT.
BE IT ORDAINED BY THE MAYOR AND THE CITY COUNCIL OF THE CITY OF
OSHKOSH, NEBRASKA:
SECTION 1.
§ 73-17 License or Permit Required is hereby amended as follows:
Any person operating an all-terrain vehicle or utility-type vehicle as authorized in §
73.16(A) shall have proof upon their person of:
(A) A valid Class O operator’s license or a farm permit as provided by Neb. RS 60-4,126;
(B) Liability insurance coverage for the all-terrain vehicle or utility-type vehicle while
operating the vehicle on a street or highway. The person operating such vehicle shall provide
proof of such insurance coverage to any peace officer requesting such proof within five days of
such request; and
(C) Operator must be at least 19 years of age. (Prior Code, § 4-2.13)
(D) No person shall operate an all-terrain vehicle or utility-type vehicle on the streets of
the city until the owner has provided proof of insurance to the City Office or city designee for the
City of Oshkosh and obtained an insurance decal for the current year. The City of Oshkosh will
issue a decal for the current year which shall be affixed to the all-terrain vehicle or utility-type
vehicle in a conspicuous place. All insurance decals will expire on December 31 in the year of
issuance and must be renewed on or before January 1 of each year. The city will charge a fee of
$25 for the issuance of such insurance decal.
SECTION 2.
Any other ordinance or section passed and approved prior to passage, approval, and
publication or posting of this ordinance and in conflict with its provisions is repealed.
SECTION 3.
This ordinance shall be in full force and effect from and after its passage, approval and
publication according to law.

NEBRASKA, AS RECOMMENDED BY THE PLANNING COMMISSION; TO REPEAL
ALL OTHER ORDINANCES AND RESOLUTIONS, OR PARTS THEREOF IN
CONFLICT; TO PROVIDE THAT THE PROVISIONS OF THIS ORDINANCE SHALL
BE MADE A PART OF THE CODE OF THE CITY OF OSHKOSH; AND TO PROVIDE
WHEN THIS ORDINANCE SHALL BE IN FULL FORCE AND EFFECT.
BE IT ORDAINED BY THE MAYOR AND THE CITY COUNCIL OF THE CITY OF

SECTION 1.
Pursuant to Section 15 of the City of Oshkosh Zoning Ordinance and upon the favorable
recommendation of the Planning Commission after the required public hearings:
A triangular tract of land located in Tax Lot 5 of the Southwest Quarter of Section 25, Township
17 North, Range 44 West of the 6th P.M., Garden County, Nebraska, describe as follows:
Referring to the Southwest Corner of Section 25; thence easterly on the South Line of the
Southwest Quarter of said Section 25 a distance of 33.0 feet; thence northerly on a line 33.0 feet
easterly from and parallel to the West Line of said Southwest Quarter a distance of 963.0
feet to the point of beginning; thence continuing northerly on the last described course produced
a distance of 295.0 feet; thence easterly 90 degrees right a distance of 295.0 feet; thence
southwesterly 135 degrees 00 minutes right a distance of 417.1 feet to the point of beginning,
containing 1.0 acre, more or less which is currently zoned “R-1” Residential is hereby rezoned as
“C” Commercial.
SECTION 2.
The Official Zoning Map for the City of Oshkosh shall be changed to reflect the
amendment as contained herein and shall reincorporate such map as amended.
SECTION 3.
Any other ordinance or section passed and approved prior to passage, approval, and
publication or posting of this ordinance and in conflict with its provisions is repealed.
SECTION 4.
This ordinance shall be in full force and effect from and after its passage, approval and
publication according to law.

AN ORDINANCE OF THE CITY OF OSHKOSH, GARDEN COUNTY, NEBRASKA, TO
AMEND THE ZONING AS IDENTIFIED HEREIN, OSHKOSH, GARDEN COUNTY,
NEBRASKA, AS RECOMMENDED BY THE PLANNING COMMISSION; TO REPEAL
ALL OTHER ORDINANCES AND RESOLUTIONS, OR PARTS THEREOF IN
CONFLICT; TO PROVIDE THAT THE PROVISIONS OF THIS ORDINANCE SHALL
BE MADE A PART OF THE CODE OF THE CITY OF OSHKOSH; AND TO PROVIDE
WHEN THIS ORDINANCE SHALL BE IN FULL FORCE AND EFFECT.
BE IT ORDAINED BY THE MAYOR AND THE CITY COUNCIL OF THE CITY OF
OSHKOSH, NEBRASKA:
SECTION 1.
Pursuant to Section 15 of the City of Oshkosh Zoning Ordinance and upon the favorable
recommendation of the Planning Commission after the required public hearings:
A triangular tract of land located in Tax Lot 5 of the Southwest Quarter of Section 25, Township
17 North, Range 44 West of the 6th P.M., Garden County, Nebraska, describe as follows:
Referring to the Southwest Corner of Section 25; thence easterly on the South Line of the
Southwest Quarter of said Section 25 a distance of 33.0 feet; thence northerly on a line 33.0 feet
easterly from and parallel to the West Line of said Southwest Quarter a distance of 963.0
feet to the point of beginning; thence continuing northerly on the last described course produced
a distance of 295.0 feet; thence easterly 90 degrees right a distance of 295.0 feet; thence
southwesterly 135 degrees 00 minutes right a distance of 417.1 feet to the point of beginning,
containing 1.0 acre, more or less which is currently zoned “R-1” Residential is hereby rezoned as
“C” Commercial.
SECTION 2.
The Official Zoning Map for the City of Oshkosh shall be changed to reflect the
amendment as contained herein and shall reincorporate such map as amended.
SECTION 3.
Any other ordinance or section passed and approved prior to passage, approval, and
publication or posting of this ordinance and in conflict with its provisions is repealed.
SECTION 4.
This ordinance shall be in full force and effect from and after its passage, approval and
publication according to law.

Motion by Piva, seconded by Schwartz to approve the Planning & Zoning Committee Conditional Use recommendations for a tower at 1003 W Ave L. Motion carried unanimously.
