City of Oshkosh Minutes January 9, 2020
The City of Oshkosh Mayor and City Council met for regular session on January 9, 2020 at 7:00 p.m.
In compliance with the Open Meetings Act of Nebraska, a current copy of the act is posted in the Council Chambers. Notice of this meeting was posted at City Hall, Garden County Courthouse, and Post Office, and advertised in the Garden County News. The agenda for this meeting was kept current and available for inspection at the office of the City Clerk.
Mayor Levick called the meeting to order and read the Open Meetings Act, LB 898.
Present were: Mayor, Jim Levick, Council Members: Gary DeCock, Terry Davis, and Mike Piva. Absent: Sarena Assmann. Also attending: Administrator, Bill Campbell, Attorney, Mary Kay Robinson-Boone, and Clerk, LeAnn Brown.
Motion made by Davis, seconded by DeCock, to approve the agenda, approve the minutes of the previous meetings and to waive the reading thereof. Motion carried unanimously.
Motion by DeCock, seconded by Piva, to approve the Treasurer’s Report. Motion carried unanimously.
A motion by DeCock, seconded by Davis, to approve the following bills. Motion carried unanimously. Salaries-15,464.91, IRS-4,521.36, NE Dept. of Revenue-3,113.21, Ameriprise Financial-1,701.00, Bank of America-261.25, Black Hills Energy-922.77, Blue Cross Blue Shield-7,776.13, Bytes-64.00, CenturyLink-161.65, Eagle Auto Supply-507.53, Emmitt’s Repair-579.10, Garden Co. OLD BUSINESS:
The Health Board did not meet.
The Mayor and Council discussed having rental properties inspected by the City before water/sewer is turned on. This item will be on the next meeting agenda with a check list that must be met to have utilities on.
Trash rates were discussed.
NEW BUSINESS:
Sheriff Deputy Yost was in attendance. The Sheriff’s Report will be available at a later date.
The Animal Report was not obtainable.
Regional West Garden County, CEO Allen Gamble came before the Mayor and Council to request that two crosswalks be painted on West 2nd Street going across the street to the parking lot. A motion by Piva, seconded by Davis, to paint the crosswalks. Motion carried unanimously.
Motion by Davis, seconded by Piva, to approve Resolution No. 01-20. Motion carried unanimously.
RESOLUTION NO. 01-20
BE IT RESOLVED by the Mayor and City Council of the City of Oshkosh, in the State of Nebraska as follows:
Section 1. That pursuant to its authority under State Statute the Mayor and City Council hereby revises and set the rates for sewer service provided by the City of Oshkosh:
Section 2. That effective February 1, 2020, rates for sewer usage shall be charged as follows for every primary and additional separately sewer service and each and every residence and business inside the city limits of Oshkosh, Nebraska.
NOW, THEREFORE BE IT RESOLVED:

Single Dwelling $ 28.00 per month
Churches $ 19.00 per month
Light Commercial:
Retail Stores $ 30.00 per month
Businesses & Offices $ 30.00 per month
Gas Stations $ 30.00 per month

Restaurants or Entities Serving Food $ 25.50 per month
Grocery Stores $ 35.00 per month
Car Washes $ 41.00 per month
Hotels, Motels & Bed & Breakfasts $ 22.00 per unit per month
Laundromats $ 41.00 per month

Shut Off & Re-Connection Fee: $40 will be charged as a re-connection fee for service that has been turned off because of a delinquent bill during business hours. $125 will be charged as a re-connection fee for service that has been turned off because of a delinquent bill after business hours.
Surcharge. Any user which discharges any toxic pollutants which cause an increase to the cost of managing the effluent or the sludge from the city’s treatment works, or any user which discharges any substance which singly or by interaction with other substances causes identifiable increases in the costs of operation and maintenance of the treatment works, shall pay for such increased costs. The charge to each such user shall be determined by the responsible plant operating personnel and approved by the City Council. The user charge rates in this resolution apply to all users, regardless of their location of the city’s treatment works.
Sewage Dumping. A charge of 67.00 per 1000 gallons for sewage dumping at the sewer lagoons.
Section 3. This resolution replaces any previous resolution or ordinance regarding sewer rates.

Allen Gamble, CEO for Regional West Garden County Hospital, came before the Mayor and Council to request painting of two crosswalks going across the street from the hospital to the parking lot on West 2nd Street. Motion made by Piva, seconded by DeCock to allow the request.
Motion carried unanimously.
Mayor Levick signed all documents for the request of grant funds for Grant Number 19-WW-003.
A motion by DeCock, seconded by Piva, to approve Resolution No. 02-20.
RESOLUTION NO. 02-20
WHEREAS, the City of Oshkosh, Nebraska recognizes that a properly functioning sanitary sewer system is necessary to the health and welfare of the citizens of the City; and
WHEREAS, the Mayor and City Council have determined that portions of the City sanitary sewer system are
in need of significant repair and improvement; and
WHEREAS, funding for the cost of the repair and improvement of portions of the City sanitary sewer system may be obtained by loan from the Nebraska Department of Environment and Energy, subject to certain requirements and obligations;
NOW, THEREFORE, BE IT RESOLVED by THE Mayor and City Council Board of Trustees of the City of Oshkosh, Nebraska that they should execute the contract for loan between the Nebraska Department of Environment and Energy and the City of Oshkosh, Nebraska designated as Project No C317805, incorporated by reference into this Resolution as if fully set forth; and
BE IT FURTHER RESOLVED, James R. Levick, Mayor, is hereby directed to execute the Agreement and all other documents necessary to facilitate the Loan between the Nebraska Department of Environment and Energy and the City of Oshkosh, Nebraska for the purpose of repairing and improving the sanitary sewer system; and
BE IT FURTHER RESOLVED THAT LeAnn Brown, Clerk be authorized and directed to sign all necessary documents, to furnish such assurances to the State of Nebraska as may be required by law or regulations, and to receive payment on behalf of the applicant.

Mayor Levick declared January as Radon Month.
The Mayor and Council discussed adding to the Zoning Code language that eaves must be present on accessory buildings. A Planning and Zoning Commission meeting will be held February 15, 2020.
Motion made by Piva, seconded by Davis, to adjourn the meeting at 8:18 p.m. Motion carried unanimously.
