The City of Oshkosh Mayor and City Council met for regular session on June 17, 2021 at 5:00 p.m.
In compliance with the Open Meetings Act of Nebraska, a current copy of the act is posted in the Council Chambers. Notice of this meeting was advertised in the Garden County News and posted at the Oshkosh Post Office, City Hall and Courthouse. The agenda for this meeting was kept current and available for inspection at City Hall.
Mayor Davis called the meeting to order and read the Open Meetings Act, LV 898.
Present were: Mayor Terry Davis, Council Members: Gary DeCock, Mike Piva, Cole Birkel, George Zoucha. Also attending: Administrator, Bill Campbell, Attorney, Mary Kay Robinson-Boone, Clerk, LeAnn Brown.
Motion by DeCock, seconded by Piva, to approve the agenda, approve the minutes of the previous meetings and to waive the reading thereof. Motion carried unanimously.

The Animal Control Report was reviewed.
Motion by Piva, seconded by Zoucha to allow Jordan Russell to block off the street at 211 West Ave J on July 4th for a block party from 1:00-7:00 p.m. Motion carried unanimously.
Motion by Birkel, seconded by DeCock, to allow Garden County Chamber’s request for an inflatable activity in the park on July 4th. Motion carried unanimously.
Amber Kuskie, representing WCNDD, presented the findings concerning the Nuisance Ordinance. Kuskie presented pictures of properties that have not complied with said ordinance. Ten resolutions were submitted to the Council by WCNDD to declare them
nuisances pursuant to Ordinance No. 467. All approved resolutions may be rescinded if the property complies with the City Code. The full resolutions are on file for public reading. Kuskie reported that 57 courtesy letters were sent, one extension granted, and 46 properties have now complied with city code.

ORDINANCE NO. 468
AN ORDINANCE TO ALLOW THE SALE OF ALCOHOL ON SUNDAY, JULY 4, 2021, NOT TO REPEAL BUT TO BE A ONE DAY EXCEPTION TO EXISTING ORDINANCE PROHIBITING SALE OF ALCOHOL ON SUNDAYS; AND TO PROVIDE FOR AN EFFECTIVE DATE OF THIS ORDINANCE.
BE IT ORDAINED BY THE MAYOR AND CITY COUNCIL OF THE CITY OF OSHKOSH, NEBRASKA, AS FOLLOWS:
SECTION 1. The City of Oshkosh hereby approves the sale of alcohol within the City of Oshkosh on Sunday, July 4, 2021.
SECTION 2. This is a one-day exception to the existing Ordinance of the City of Oshkosh prohibiting the sale of alcohol on Sundays and does not repeal the existing Ordinances regarding the sale of alcohol within the City of Oshkosh.
SECTION 3. This Ordinance shall take effect and be in full force and after its passage, approval and publication as required by law.

Motion by Zoucha, seconded by Birkel, to approve an SDL Application for the Water Tower Project to be held on July 3, 2021 at 103 E. Ave E from 7:00-9:00 p.m. Voting Aye: Zoucha, Birkel, DeCock. Abstained: Piva. Motion carried.
Motion by DeCock, seconded by Zoucha, to allow the Water Tower Project to block off the street at Ave E from Main Street to the alley on July 3, 2021 at 4:00 p.m. for the Water Tower Dedication. Voting Yea: DeCock, Zoucha, Birkel. Abstained: Piva. Motion carried.
LARM’s article on Workplace Violence was discussed.
Motion by Zoucha, seconded by Birkel, to grant a time extension on the Sewer Project. Motion carried unanimously.
Motion by Piva, seconded by Zoucha, to adhere to the auditor’s request of forgiving old accounts
for nonpayment of occupation and delinquent fees. Motion carried unanimously.
Motion by Piva, seconded by DeCock, to approve Economic Development Advisory Committee’s recommendation to loan Tyler Ardissono $6,127.81 dba Panhandle Tech Net for business expansion. Motion carried unanimously.
Motion by DeCock, seconded by Birkel, to buy life and disability insurance for city employees from Reliance Standard Company. Motion carried unanimously.
Motion by Piva, seconded by Zoucha, to allow the Wesleyan Church to members give swimmers a root beer float after completion of swimming lessons on July 2nd in the park. Motion caried unanimously.
Motion by Birkel, seconded by Zoucha, to allow a Fowl & Livestock Permit for Allan Beberniss at 407 E. 4th Street. Motion carried unanimously.
Attorney Robinson-Boone discussed with the Council about abandoning a street on Ave H, near the ballfield. More information will be available at the next regular meeting.
