The City of Oshkosh Mayor and City Council met for regular session on November 9, 2017 at 7:00 p.m.
In compliance with the Open Meetings Act of Nebraska, a current copy of the act is posted in the Council Chambers. Notice of this meeting was posted at City Hall, Garden County Courthouse, and Post Office. The agenda for this meeting was kept current and available for inspection at the office of the City Clerk.
Mayor Levick called the meeting to order and read the Open Meetings Act, LB 898.
Present were: Mayor, Jim Levick and Council Members: David Cook, Gary DeCock, Sarena Assmann, and Terry Davis. Also attending: Attorney, Mary Kay Robinson-Boone, Administrator, Bill Campbell, and City Clerk, LeAnn Brown.
Motion made by DeCock, seconded by Cook, to approve the agenda, approve the minutes of the previous meeting and to waive the reading thereof. Motion carried unanimously.
Motion by Cook, seconded by Davis, to approve the Treasurer’s Report. Motion carried unanimously.
A motion by Assmann, seconded by Cook, to approve the following bills. Motion carried unanimously. A motion made by Davis, seconded by DeCock, to accept Dan’s Landscape & Tree Service’s proposal for the removal of dead trees with the understanding that several have already been taken down. Motion carried unanimously.
Assmann made a motion and Cook seconded the motion to purchase playground equipment for the City Park from Burke in the amount of $16,695.00. Motion carried unanimously.
NEW BUSINESS:
The Sheriff’s Report was gone over with Deputy Yost.
The Animal Officer’s Report was reviewed.

BE IT RESOLVED by the Mayor and City Council of the City of Oshkosh, in the State of Nebraska as follows:
Section 1. Resolution No. 14-17 of the City of Oshkosh is to read as follows:
MUNICIPAL TRASH SERVICE RATES. Commencing with the February 2018, billing, each resident user and each and all business users shall pay for services provided by the City of Oshkosh on a flat rate monthly schedule as follows:
Residential per Month:
One Member Household Age 65 and Older $12.00
Two Member Household Age 65 and Older $13.50
Resident Customer $15.00
Apartment/Duplexes per Unit $15.00
Churches $ 9.00
Yard Waste Pickup per Month: $7.00
Rural per Month:
1 ½ Yard Dumpster $18.50
(2) Pickups per Month for 3-Yard Dumpster $37.00
2 – 3 Yard Dumpster Weekly Pickup $158.00
Alternate Trash Route #1: People that Haul Their Own Trash $15.50
Alternate Trash Route #2: People that Haul City Owned Dumpster
Back & Forth to Trash Shop $17.50
Commercial per Month:
Light Users $16.50

Re-Connection Fee:
$40 will be charged as a re-connection fee for service that has been terminated because of a delinquent bill during business hours. $125 will be charged as a re-connection fee for service that has been terminated because of a delinquent bill after business hours.
Section 3. It is the responsibility of the resident to inform the office of the City Clerk as to a rate change due to age and number of household occupants when change occurs.
Section 4. This resolution replaces any previous resolution or ordinance regarding trash rates.
No action taken for a Permit to Keep Livestock to Debbee Doles at 1009 E. 2nd Street due to Doles needs all neighbors’ permission and how the animals will be restricted to the property.
The rates for the City Auditorium were discussed. The rates will remain the same.
A motion by Assmann, seconded by Cook to allow a donation of a Pepsi refrigerator to be permanently placed at the City Auditorium. Motion carried unanimously.
A motion made by Cook, seconded by Davis, to approve a building permit for Brenda DeCock. Voting Yea: Cook, Davis, and Assmann. Abstained: DeCock. Motion carried.
A motion made by Davis, seconded by Assmann, to approve a building permit for Mike Boone. Motion carried unanimously.
DeCock made a motion to approve Change Order No. 1 – DN Tanks, Inc., - Installation of clay casp at GST footings in lieu of perimeter drain per Addendum #3 to the Geotechnical Engineering Report less-$11,940.00, contingent that Miller & Associates can clarify the change. Cook seconded the motion. Motion carried unanimously.
Motion by DeCock, seconded by Cook, to approve Ordinance No. 438. Motion carried unanimously.
ORDINANCE NO. 438
AN ORDINANCE OF THE CITY OF OSHKOSH, NEBRASKA, ADOPTING AMENDED GARDEN COUNTY AIRPORT ZONING REGULATIONS, PROPOSED BY THE JOINT GARDEN COUNTY AIRPORT ZONING COMMISSION PURSUANT TO NEB. REV. STAT. 19-901, PROVIDING WHEN SAID ORDINANCE SHALL BECOME EFFECTIVE AND REPEALING ALL ORDINANCES IN CONFLICT HEREWITH.
BE IT ORDAINED BY THE MAYOR AND CITY COUNCIL OF THE CITY OF OSHKOSH.
Section 1. There is hereby Amended Garden County Airport Zoning Regulations for the City of Oshkosh which shall be designated as “Zoning Regulations for the City of Oshkosh, Section 12, Airport Zoning Regulations”. These Zoning Regulations were created in accordance with State and Federal Law by the Joint City and County Garden County Airport Zoning Commission. These Garden County Airport Zoning Regulations shall regulate and restrict the erection, construction, reconstruction, alteration, repair or use of buildings, structures or land and water use in the Garden County Airport Zone; how such regulations shall be e3stablished and enforced, and from time to time amended, supplemented or changed; by making certain exceptions; by creating the Joint Garden County Airport Board of Adjustment; by providing for the enforcement of and the penalties for the violation of any of its provisions; for the purpose of promoting Airport safety.
Section 2. All Ordinances or parts of Ordinances in conflict herewith are hereby repealed.
Section 3. The requirement that this Ordinance be read by title on three different days is hereby suspended by vote of a least four members of the City Council of the City of Oshkosh.
Section 4. This Ordinance shall take effect and be in full force from and after its passage, approval and publication as required by law; providing penalties for the violation of the various chapters, articles and sections thereof and providing for publication and distribution of this ordinance and the Garden County Airport Zoning Regulations for the City of Oshkosh themselves.
Passed and approved this 9th day of November, 2017.
A motion by Davis, seconded by Cook, to approve the re-naming of the Oshkosh Airport to: The Garden County Airport – King Rhiley Field. Motion carried unanimously.
A motion by Cook, seconded by DeCock, to approve the recommendation from the Economic Development Advisory Review Committee to approve a loan of $9,600.00 to Sally Corfield. Motion carried unanimously.
