OSHKOSH CITY COUNCIL MINUTES MAY 9, 2019
The City of Oshkosh Mayor and City Council met for regular session on May 9, 2019 at 7:00 p.m.
In compliance with the Open Meetings Act of Nebraska, a current copy of the act is posted in the Council Chambers. Notice of this meeting was posted at City Hall, Garden County Courthouse, and Post Office, and advertised in the Garden County News. The agenda for this meeting was kept current and available for inspection at the office of the City Clerk.
Mayor Levick called the meeting to order and read the Open Meetings Act, LB 898.
Present were: Mayor, Jim Levick and Council Members: Gary DeCock, Sarena Assmann, Terry Davis, and Mike Piva. Also attending: Attorney, Mary Kay Robinson-Boone, Administrator, Bill Campbell, and City Clerk, LeAnn Brown.
Motion made by Davis, seconded by DeCock, to approve the agenda, approve the minutes of the previous meeting and to waive the reading thereof. Motion carried unanimously.
Motion by Assmann, seconded by Piva, to approve the Treasurer’s Report. Motion carried unanimously.
A motion by DeCock, seconded by Davis, to approve the following bills. Motion carried unanimously. OLD BUSINESS:
The Health Board Report was reviewed.
Ron and Lynne Klemke, Carol Santero, and Buddy Paulsen all spoke to the Mayor and Council concerning the building permit submitted by Jess Underwood for a 36’x48’ garage at 415 West 6thStreet. These persons spoke against approval of said building permit and requested the City Council to table the approval of said permit until more conversation can be held with the Underwood’s. Randy Stanczyk spoke to the Mayor and Council in favor of Underwood’s building permit.
A motion was made by DeCock to approve a building permit for Jess Underwood. Motion died for a lack of a second motion.
A motion was made by Davis, seconded by DeCock, to table the building permit for Jess Underwood. Motion carried unanimously.
NEW BUSINESS:
A Sheriff’s Report was not available.
Scotty Ray, Animal Control Officer gave his monthly report.
Chris Miller, Miller & Associates, gave a power point presentation on the sewer project that the DEQ is forcing the City of Oshkosh to execute. Miller also went over the proposed sewer rates that will be needed to pay back the loan to complete said project.
Joanna Kepler came before the Mayor and Council to ask permission to close the north end of West 4thStreet and the dirt road going west of her house at 505 West 4thon June 8 for a wedding reception and dance, between the hours of 9:00 a.m. to 3:00 p.m. A motion by Davis, seconded by Assmann, to allow the partial closing of West 4thand the dirt road. Motion carried unanimously.
A motion by Piva, seconded by Davis, to approve Resolution No. 06-19. Motion carried unanimously.
RESOLUTION NO. 06-19
BE IT RESOLVED by the Mayor and City Council of the City of Oshkosh, in the State of Nebraska as follows:
Section 1. That pursuant to its authority under State Statute the Mayor and City Council hereby revises and set the rates for sewer service provided by the City of Oshkosh:
Section 2. That effective June 1, 2019, rates for water usage shall be charged as follows for every primary and additional separately sewer service and each and every residence and business inside the city limits of Oshkosh, Nebraska.
NOW, THEREFORE BE IT RESOLVED:

Residential
Single Dwelling $ 20.00 per month
Multiple Dwelling $ 20.00 per month
Churches $ 15.00 per month
Light Commercial:
Retail Stores $ 22.00 per month
Businesses & Offices $ 22.00 per month
Heavy Commercial:
Gas Stations $ 27.00 per month
Restaurants or Entities Serving Food $ 27.50 per month
Car Washes $ 33.00 per month
Hotels, Motels & Bed & Breakfasts $ 14.00 per unit per month
Laundromats $ 33.00 per month
Courthouse $ 33.00 per month
Heavy Institutional & Industry
Schools $ 53.00 per month
Hospital and or/Nursing Homes $ 53.000 per month

OUTSIDE CORPORATE LIMITS:
Residential $ 27.00 per month
Businesses $ 33.00 per month
Shut Off & Re-Connection Fee: $40 will be charged as a re-connection fee for service that has been turned off because of a delinquent bill during business hours. $125 will be charged as a re-connection fee for service that has been turned off because of a delinquent bill after business hours.
Surcharge. Any user which discharges any toxic pollutants which cause an increase to the cost of managing the effluent or the sludge from the city’s treatment works, or any user which discharges any substance which singly or by interaction with other substances causes identifiable increases in the costs of operation and maintenance of the treatment works, shall pay for such increased costs. The charge to each such user shall be determined by the responsible plant operating personnel and approved by the City Council. The user charge rates in this resolution apply to all users, regardless of their location of the city’s treatment works.
Sewage Dumping. A charge of 59.00 per 1000 gallons for sewage dumping at the sewer lagoons.
Section 3. This resolution replaces any previous resolution or ordinance regarding sewer rates.

A motion by DeCock, seconded by Davis to approve building permits for Dale Jenkins and Perry Swisher. Motion carried unanimously.
A motion by Piva, seconded by Assmann, to approve Mayor Levick’s appointment of Troy Jasnoch to the Planning & Zoning Commission. Motion carried unanimously.
Sara Dana PT, representing RWGC, requested to have a senior swim exercise class at the swimming pool from 12:15 p.m. to 12:45 p.m., two days a week. A motion by Assmann, seconded by DeCock, to allow the swim class. Motion carried unanimously.
A motion by DeCock, seconded by Assmann, to adjourn the meeting at 8:56 p.m. Motion carried unanimously.
