City Council Meeting Minutes March 9, 2017
The City of Oshkosh Mayor and City Council met for regular session on March 9, 2017 at 7:00 p.m.
In compliance with the Open Meetings Act of Nebraska, a current copy of the act is posted in the council chambers. Notice of this meeting was posted at City Hall, Garden County Courthouse, and Post Office. The agenda for this meeting was kept current and available for inspection at the office of the City Clerk.
Mayor Levick called the meeting to order and read the Open Meetings Act, LB 898.
Present were: Mayor, Jim Levick and Council Members: David Cook, Gary DeCock, Sarena Assmann and Terry Davis. Also attending: Attorney, Mary Kay Robinson-Boone, Administrator, Bill Campbell, and City Clerk, LeAnn Brown.
Motion made by DeCock, seconded by Assmann, to approve the change of order for the agenda, approve the minutes of the previous meeting and to waive the reading thereof. Voting Yea: DeCock, Assmann, and Cook. Abstained: Davis. Motion carried.
Motion by Assmann, seconded by Cook, to approve the Treasurer’s Report. Motion carried unanimously.
A motion by Cook, seconded by DeCock, to approve the following bills. Motion carried unanimously. Mayor Levick welcomed the people in attendance.
OLD BUSINESS:
The Health Board Report was gone over. Attorney Robinson-Boone will send certified letters to the residents that are in violation of the city code.
NEW BUSINESS:
Sheriff Quinn handed out the February Sheriff’s Report.
Jeff Kelley, Executive Director for Panhandle Area Development, gave an update on PADD and what PADD is about and the services they provide.
Judy Soule was present for her request for a Llama Permit. Motion by Assmann, seconded by Davis, to approve the permit for three llamas from April to October 2017. Motion carried unanimously.
Scotty Ray, Animal Control Officer, gave his report.
Agenda Item # 2 OLD BUSINESS: Attorney Robinson-Boone went over the application for a Variance Request for the water project. The Mayor and Council discussed at length, how to proceed with said application.
Motion by Cook, seconded by DeCock, to approve a building permit for Kristine Seibel. Motion carried unanimously.
At this time, the Mayor and Council viewed a DVD on Fair Housing. HUD Fair Housing pamphlets are available at City Hall for the public. The National Fair Housing Month is in April.
Motion by DeCock, seconded by Davis, to approve a Special Designated Liquor License Application for Fraternal Order of Eagles on April 15, 2017, at the City Auditorium for the Pheasants Forever Banquet. Voting Yea: DeCock, Davis, and Assmann. Abstained: Cook. Motion carried.
Motion by Davis, seconded by Cook, to approve Resolution No. 02-17. Motion carried unanimously.
RESOLUTION NO. 02-17
BE IT RESOLVED by the Mayor and City Council of the City of Oshkosh, in the State of Nebraska as follows:
Section 1. That pursuant to its authority under 5-3.4 of the Ordinances of the City of Oshkosh, the Health Board has investigated, confirmed and presented the existence of a nuisance to the Mayor and City Council of the City of Oshkosh for their consideration.
Section 2. This resolution shall stand as a statement of the Mayor and City Council that there does exist at 401 West Avenue D, Oshkosh, Nebraska, and a nuisance in violation of 5-3.
Section 3. This resolution does hereby authorize the City Attorney to proceed with Administrative Procedure of abatement or further judicial abatement as set forth in 5-3.6 of the Ordinances of the City of Oshkosh.
