The City of Oshkosh Council met for regular session September 8, 2022, at 5:00 p.m.
In compliance with the Open Meetings Act of Nebraska, a current copy of the act is posted in the Council Chambers. Notice of this meeting was advertised in the Garden County News and posted at the Oshkosh Post Office, City Hall, and Courthouse. The agenda for this meeting was kept current and available for inspection at City Hall.
Mayor Davis called the meeting to order and read the Open Meetings Act, LV 898.
Present: Terry Davis, Mayor and Council Members: Mike Piva, Gary DeCock, George Zoucha, Jaden Porter. Also attending: Administrator, Bill Campbell, Attorney, Mary Kay Robinson-Boone, City Clerk, LeAnn Brown, Interim Administrator, Al LeClair.
Motion by Zoucha, seconded by DeCock, to approve the consent agenda: minutes, claims, Treasurer’s Report. Motion carried unanimously.

OLD BUSINESS:
Attorney Robinson-Boone & Sheriff Ross discussed with the council using some of the ARPA funds to buy a speed trailer for use on the highway in Oshkosh and Lewellen.
Motion by DeCock, seconded by Zoucha, to approve budget billing for utility customers. Motion carried unanimously. Customers will need to signup for ACH and follow other rules.
NEW BUSINESS:
Erica Bush, representing WCNDD gave a presentation on the nuisance agreement. Motion by Piva, seconded by Zoucha, to declare a nuisance by Resolution No. 32-33 (OSH 053). Motion carried unanimously. The full resolution is on file at City Hall for public reading.
Motion by Piva, seconded by Zoucha to abate the following properties: 2002 OSH 001, 2002 OSH 003, OSH 045, OSH 049, OSH 060. Motion carried unanimously.
Motion by DeCock, seconded by Porter, to rescind by Resolution No. 33-22 201 E. Ave I and Resolution No. 34-22 108 E. Ave F. Motion carried unanimously. The full resolutions are on file at City Hall for public reading.
Trevor Schuessler, from Rauner & Associates, went over the proposed budget for 2022-2023.
Sheriff Ross presented the Sheriff’s Report.
The Animal Control Report was discussed.
The council discussed charging food trucks an occupation tax. An ordinance reflecting this will be on the next meeting’s agenda.
Sewer rates were discussed. Raising the rates will be on the October agenda.
Motion by DeCock, seconded by Porter, to approve building permits to Larry Schwartzkopf and Allan Beberniss. Motion carried unanimously.
Motion by Piva, seconded by DeCock, to approve Resolution No. 36-22. Motion carried unanimously.
RESOLUTION NO. 36-22
WHEREAS: State of Nebraska Statutes, sections 39-2115, 39-2119, 39-2120, 39-2121, and 39-2520(2), requires an annual certification program compliance to the Nebraska Board of Public Roads Classifications and Standards; and
WHEREAS: State of Nebraska Statute, section 39-2120 also requires that the annual certification of program compliance by each municipality shall be signed by the Mayor and shall include the resolution of the governing body of the municipality authorizing the signing of the certification.
BE IT RESOLVED that the Mayor is hereby authorized to sign the Municipal Annual Certification of Program Compliance.

The first reading of Ordinance No. 370 was held. An ordinance to allow the sale of alcohol to repeal and replace existing ordinance prohibiting the sale of alcohol on Sundays. The full ordinance is on file at City Hall for public reading.
The council discussed an ordinance for vacant property registration, establish fees, and provide for appeal pursuant to the vacant property registration act. An ordinance will be on the October agenda pertaining to this.
Over-night camping in the city parks was discussed. The city currently has an ordinance prohibiting over-night camping in the parks.
Motion by DeCock, seconded by Piva, to adjourn the meeting.

Mayor Davis opened the Budget Hearing at 7:01 a.m. Clerk Brown handed out the summarized budget from Trevor Scchussler. Mayor Davis asked for public comment concerning the proposed budget. Debra Condra asked several questions and Mayor Davis and Clerk Brown answered her questions concerning proposed budget. No other persons spoke in favor or against proposed budget.
Mayor Davis closed the hearing at 7:09 a.m.
Motion by DeCock, seconded by Porter, to adopt the proposed budget for 2022- 2023. Motion carried unanimously.
Motion by Zoucha, seconded by Piva, to set levies at a different amount than the prior year tax request. Motion carried unanimously.
Motion by Piva, seconded by Zoucha, to approve Resolution No. 35-22. Motion carried unanimously.
RESOLUTION NO. 35-22
SETTING THE PROPERTY TAX REQUEST
WHERES, Nebraska Revised Statute 77-1623 and 77-633 provides that the Governing Body of the Cit of Oshkosh passes by a majority vote a resolution or ordinance setting the tax request; and
WHEREAS, a special public hearing was held as required by law to hear and consider comments concerning the property tax request;
NOW, THEREFORE, the Governing Body of the City of Oshkosh resolves that:
Bond Fund: $ 50,194.00
Passed and approved this 23rd day of September, 2022.

Mayor Davis opened the Public Hearing at 7:13 a.m., for an application for a CK Liquor License for Wishing Well Holdings, LLC dba Wishing Well. No persons spoke in favor or against said application. Mayor Davis closed the hearing at 7:18 a.m.
Motion by Piva, seconded by Porter to approve an application for a CK Liquor License for Wishing Well Holdings, LLC. Motion carried unanimously.

SETTING THE PROPERTY TAX REQUEST

WHEREAS, a special public hearing was held as required by law to hear and consider comments concerning the property tax request;
NOW, THEREFORE, the Governing Body of the City of Oshkosh resolves that:
- The 2022-2023 property tax request be set at:
Bond Fund: $ 50,194.00
- The total assess value of property differs from last year’s total assessed value by 19.05 percent.
- The tax rate which would levy the same amount of property taxes as last year, when multiplied by the new total assessed value of property would be 0.294402 per $100 of assess value.
- The City of Oshkosh proposes to adopt a property tax request that will cause its tax rate to be 0.322178 per $100 assess value.
- Based on the proposed property tax request and changes to other revenue, the total operating budget of the City of Oshkosh will increase last year’s budget by 7.67 percent.
- A copy of this resolution be certified and forwarded to the County Clerk on or before October 15, 2022.
