The City of Oshkosh Council met for regular session December 14, at 5:00 p.m.
In compliance with the Open Meetings Act of Nebraska, a current copy of the act is posted in the Council Chambers. Notice of this meeting was advertised in the Garden County News and posted at the Oshkosh Post Office, City Hall and Courthouse. The agenda for this meeting was kept current and available for inspection at City Hall.
Mayor Davis called the meeting to order and read the Open Meetings Act, LV 898.
Present: Mayor, Terry Davis & Council Members: Mike Piva, George Zoucha, Jaden Porter. Absent: Gary DeCock. Also attending: City Administrator James Bondegard, Deputy Clerk Kim Martin, City Attorney, Rory Roundtree, Sheriff, Randy Ross, & Randy Stanczyk.
Motion by Zoucha seconded by Porter, to approve the consent agenda: agenda, minutes, claims, Treasurer’s Report. Motion carried unanimously.

Item # 10 was discussed first. Stanczyk discussed the city’s lien position. The Council and Roundtree discussed potential options. Roundtree was going to have more direction at the January meeting.

Motion by Zoucha seconded by Piva to approve bid from Cooper Steel Construction to build new shade structure in the park. Motion carried unanimously.

ORDINANCE NO. 479
AN ORDINANCE OF THE CITY OF OSHKOSH, GARDEN COUNTY, NEBRASKA, TO AMEND CHAPTER 2, ARTICLE 2; SECTION 2-6.1, OF THE CITY CODE BOOK, TITLED “CONTRACTS AND PURCHASES; BIDDING AND OTHER REQUIREMENTS”; TO PROVIDE THAT THE PROVISIONS OF THIS ORDINANCE SHALL BE MADE A PART OF THE CODE OF THE CITY OF OSHKOSH; AND PROVIDE WHEN THIS ORDINANCE SHALL BE IN FULL FORCE AND EFFECT.
BE IT ORDAINED BY THE MAYOR AND THE CITY COUNCIL OF THE CITY OF OSHKOSH, NEBRASKA:
SECTION 1.
Chapter 2, Article 2, Section 2-6.1: CONTRACTS AND PURCHASES; BIDDING AND OTHER REQUIREMENTS is hereby amended and shall read as follows:
2-6.1.1 Except as provided in Neb. RS 18-412.01 for a contract with a public power district to operate, renew, replace, or add to the electric distribution, transmission, or generation system of the city, no contract for enlargement or general improvements, such as water extensions, sewers, public heating system, bridges, work on streets, or any other work or improvement when the cost of such enlargement or improvement is assessed to the property, costing over $30,000, shall be made unless it is first approved by the City Council.
2-6.1.2 Except as provided in Neb. RS 18-412.01, before the City Council makes any contract in excess of $30,000 for enlargement or general improvements, such as water extensions, sewers, public heating system, bridges, work on streets, or any other work or improvement when the cost of such enlargement or improvement is assessed to the property, an estimate of the cost shall be made by the City Engineer and submitted to the City Council. In advertising for bids as provided in divisions 8.1.3 and 8.1.5 of this section, the City Council may publish the amount of the estimate.
2-6.1.3 Advertisements for bids shall be required for any contract costing over $30,000 entered into:
SECTION 2.
Any other ordinance or section passed and approved prior to passage, approval, and publication or posting of this ordinance and in conflict with its provisions is repealed.
SECTION 3.
This ordinance shall be in full force and effect from and after its passage, approval and publication according to law.
Passed, approved and adopted on this 14 day of December, 2023.
Motion by Piva seconded by Zoucha to approve Maintenance Agreement renewal with Nebraska DOT. Motion carried unanimously.
Motion by Porter seconded by Zoucha to allow city to sell surplus items. Items will be listed on a first come first serve basis. Motion carried unanimously.
The council discussed the bid on a motor grader. The council wanted to get more bids.
Discussed codification of Ordinance book. No action taken.

Motion by Zoucha seconded by Porter to Elect Mike Piva for Council President. Voting Yay: Zoucha, Porter, Abstain: Piva. Motion carried.
Motion by Zoucha seconded by Piva to approve Mayor Davis appointment for 2024. Motion carried unanimously.
