The City of Oshkosh Council met for regular session June 8, 2023, at 5:00 p.m.
In compliance with the Open Meetings Act of Nebraska, a current copy of the act is posted in the Council Chambers. Notice of this meeting was advertised in the Garden County News and posted at the Oshkosh Post Office, City Hall and Courthouse. The agenda for this meeting was kept current and available for inspection at City Hall.
Mayor Davis called the meeting to order and read the Open Meetings Act, LV 898.
Present: Mayor, Terry Davis, and Council Members: Gary DeCock, Mike Piva, George Zoucha, Jaden Porter. Also attending: City Administrator James Bondegard, Deputy Clerk Kim Martin, City Attorney, Rory Roundtree, Sheriff Randy Ross, Erica Busch representing WCNDD, Debra Condra. Tony Martinez, Brad Howell, Nate Loyd & Mary Kay Robison-Boone.
Motion by Zoucha seconded by DeCock, to approve the consent agenda: agenda, minutes, claims, Treasurer’s Report. Motion carried unanimously.

Vista Beam is working on an agreement with NPPD to use power poles for equipment.
NEW BUSINESS:
Nate Loyd presented information on Baseball Tournament on June 29th-July 1st. Requested to pay Roger Orminston $300 to announce games and pay umpires $25 a game. Motion by Zoucha seconded by Piva to approve. Motion carried unanimously.
Motion By Piva seconded by Zoucha to allow Friends of Antelope Valley Historical Church to use concession stand for hamburger feed prior to kids races on July 4th fundraiser for non-profit. Motion Carried unanimously.
Sheriff Ross presented the Sheriff’s Report.
The Animal Control Report was reviewed.
Debra Condra asked about Nuisance Contract, requested updated map. Erica Busch is going to assist with request.
Erica Busch, representing WCNDD gave a presentation on the nuisance agreement. Motion by Zoucha seconded by DeCock to approve Resolutions 3-23, 4-23, 5-23 & 6-23 to declare a nuisance. Motion carried unanimously. Full Resolutions are on file at City Hall for Public Reading.
Motion by Piva seconded by Porter to rescind Resolution 5-22 106 E Ave I & 8-22 807 Main. Motion carried unanimously. The full resolutions are on file at City Hall for public reading.
The building permit for Kathy Wellman at 404 W Ave M was discussed. No action was taken on permit pending a meeting to allow a variance for structure with Planning and Zoning Committee.
Motion by DeCock seconded by Porter to approve the Sheriff’s Department to install an above ground fuel tank at 619 Main. Motion carried unanimously.
Motion by Piva seconded by Zoucha to approve Arthur & Starla Snider’s building permit 403 W Ave D. Motion carried unanimously.
Motion by Porter seconded by Zoucha to approve Michael Lara’s building permit at 105 E Ave E. Motion carried unanimously.
Motion by DeCock seconded by Piva to approve a permanent Livestock Permit for Judy Soule for her llama, with the condition that Soule applies every year for a new permit and sign new agreement. Motion carried unanimously.
Motion by Zoucha seconded by Porter to allow the Oshkosh Wesleyan Church to give swimmers free ice cream treat on June 29th or 30th.
Motion by Piva, seconded by Porter, to approve a Special Designated Liquor License for the Fraternal Orders of Eagles for a street dance & benefit on June 30, 2023. Motion carried unanimously.
No action taken to waive fee for Special Designated Liquor License. Motion Died.
Motion by Piva seconded by Porter to approve appointments of Karen Westerbuhr & Paula Bondegard to the Oshkosh Library Board.
Motion by Porter seconded by DeCock to approve Brad Howell with the Chamber of Commerce request to allow free swimming on July 4th. Motion carried unanimously.
Brad Howell representing the hospital gave an update on the press release. Regional West was not renewing the lease and that board is reviewing several options. Needed to make a decision by the first of the year.
Said Ordinance No. 474 now comes for third reading. The clerk read said Ordinance No. 474. by Title upon its third reading.
Motion by Piva seconded by Zoucha to approve Ordinance No. 474 Floodplain Management. Motion carried unanimously.
Police contract was discussed.
Clerk requested items for next year’s budget.
