The City of Oshkosh Council met for regular session August 10, 2023, at 5:00 p.m.
In compliance with the Open Meetings Act of Nebraska, a current copy of the act is posted in the Council Chambers. Notice of this meeting was advertised in the Garden County News and posted at the Oshkosh Post Office, City Hall and Courthouse. The agenda for this meeting was kept current and available for inspection at City Hall.
Mayor Davis called the meeting to order and read the Open Meetings Act, LV 898.

Broadband-Discussed Vistabeam being awarded grants & project construction. Vistabeam is planning project construction late 2023 and have internet in mid-2024.
Sewer Project-Sewer project is completed.
NEW BUSINESS:
Erica Busch, representing WCNDD gave a presentation on nuisance properties. Motion by Zoucha seconded by Porter to declare a nuisance by Resolution No.15-23, & No. 16 -23. Voting aye: Porter, Zoucha, DeCock. Absent: Piva. Motion carried. Full Resolutions are on file at City Hall for Public Reading.
Motion by DeCock seconded by Zoucha to abate 201 W 3rd, 310 W 3rd, 210 W 3rd, 103 W 4th. Voting aye: Zoucha, Porter, DeCock. Absent: Piva. Motion Carried
Motion by DeCock seconded by Zoucha to rescind by Resolution No. 14-22 609 W 1st. Voting aye; DeCock, Porter, Zoucha. Absent: Piva. Motion carried. Full resolution is on file at City Hall for public reading.
The Animal Control Report was reviewed.
Kathy Wellman requested an extension of to have accessory structure removed. Motion by Zoucha seconded by Porter to grant extension of 30 days. Voting aye: Zoucha, Porter, DeCock. Absent: Piva. Motion Carried
The second reading of Ordinance The full ordinance is on file at City Hall for public reading.
Motion by Porter seconded by Zoucha to approve Interlocal Agreement with Garden County for police protection. Voting aye: DeCock, Zoucha, Poter. Absent Piva. Motion Carried.
The council discussed trees on Main Street that are growing into power lines, some are starting to die and causing problems with utility lines and the sidewalk. They are starting to raise safety concerns. When trees were planted the guideline was that they were not to exceed 8” diameter & if they interfered with the infrastructure they shall be removed. Motion by Zoucha seconded by DeCock to remove trees and take necessary action. Voting aye: Porter, DeCock, Zoucha. Absent: Piva. Motion Carried
It was discussed about replacing current trees with smaller ornamental trees or finding suitable replacement in the future.
No Action taken on agenda item #9.
Council member Piva joined the meeting.
City Administrator Bondegard discussed the Creative District and requested permission to proceed with application and process on the possibility of Oshkosh being a Certified Creative District. Motion by porter seconded by DeCock to approve. Motion carried unanimously.
Mayor Davis opened the Public Hearing at 5:30 p.m. The purpose of the hearing was to allow public comment on Ordinance No. 478. No comments for or against were made. The hearing closed at 5:51 p.m.
Motion by Zoucha seconded by DeCock to approve Resolution 18-23 to establish new sanitation with Waste Connections raising rates by 5%. Motion carried unanimously.
RESOLUTION NO. 18-23
RESOLUTION ESTABLISHING SANITATION RATES
WHEREAS, the Mayor and Council of the City of Oshkosh, Nebraska (“City” or “Governing Body”), on this 10TH day of August, 2023, hereby resolves as follows:
WHEREAS, the City Code, § 3-3.4 RATES establishes that the Governing Body may, by resolution, establish rates for all property upon which any building has been or may be erected having a connection with any lines or pipes which are or may be construed and used in connection with the city sewer system; and
WHEREAS, the fees associated with waste collection and disposal have increased thereby necessitating an increase in rates.
NOW THEREFORE, the City hereby establishes rates for waste sanitation as follows:
Residential per Month:
Residential Customer $19.95
Residential Customer Senior $16.80
Churches $16.80
Commercial per Month:
96 gallon weekly pickup $24.15
1.5 yd weekly pickup $36.75
3 yd weekly pickup $72.45
3 yd twice weekly pickup $98.70
Schuessler discussed in detail the 2023-2024 trial budget with the council and public attending. Schuessler answered questions on budget. Budget will be finalized at the September Council meeting.
Sheriff Ross discussed the sheriff’s report.
Mayor Davis discussed hospital transition and having members of the city attend County Commissioner meeting.
Bondegard Discussed LB 840 initiative and that it expires in December of 2024. Need to make plans to have it on ballot.
Motion by Zoucha seconded by Porter, to adjourn meeting at 6:06 PM. Motion carried unanimously.
