CITY COUNCIL MINUTES MARCH 2021
The City of Oshkosh Mayor and City Council met for regular session on March 11, 2021 at 5:00 p.m.
In compliance with the Open Meetings Act of Nebraska, a current copy of the act is posted in the Council Chambers, Courthouse, and Post Office. Notice of this meeting was advertised in the Garden County News. The agenda for this meeting was kept current and available for inspection at the office of the City Clerk.
Mayor Davis called the meeting to order and read the Open Meetings Act, LB 898.
Present were: Mayor, Terry Davis and Council Members: Gary DeCock, Mike Piva, Cole Birkel and George Zoucha. Also attending: Attorney, Mary Kay Robinson-Boone, Administrator, Bill Campbell and Clerk, LeAnn Brown.
Motion made by Piva, seconded by DeCock, to approve the agenda, approve the minutes of the previous meeting and to waive the reading thereof. Voting Aye: Piva, Zoucha, Birkel, DeCock. Motion carried.
A motion by DeCock seconded by Zoucha, to approve the Treasurer’s Report. Voting Aye: DeCock, Zoucha, Birkel, Piva. Motion carried.
A motion by DeCock, seconded by Zoucha, to approve the following bills. Voting Aye: DeCock, Zoucha, Birkel, Piva. Motion carried. Motion by DeCock, seconded by Piva, to approve salary-$203.17. Voting Aye: DeCock, Birkel, Piva. Abstained: Zoucha. Motion carried.
NEW BUSINESS:
Mayor Davis opened the sealed bid for the sanitation equipment. Waste Connects dba Ogallala Hauling submitted the only bid at $450,001.00. Motion by Piva, seconded by Zoucha, to accept Waste Connections bid, contingent with a contract with the City of Oshkosh. Voting Aye: Piva, Zoucha, Birkel, DeCock. Motion carried.
Deputy Sheriff Dean handed out the Sheriff’s Report.
The Animal Control Report was reviewed.
A motion by DeCock, seconded by Zoucha, to approve change order #1 for the wastewater facility rehab and improvements. Voting Aye: DeCock, Zoucha, Birkel, Piva. Motion carried.
A discussion was held on what needs to be done with the land that the old wastewater treatment plant is currently on. Motion by Piva, seconded by Birkel, to deed the land back to the owners. Voting Aye: Piva, Birkel, Zoucha, DeCock. Motion carried.
A motion was made by Piva, seconded by Zoucha, to have an auction to sell Lots 10, 11, and 12, Block 5, A. Sudman Addition, on April 8, 2021 at 4:45, at City Hall and the minimum bid is $4,000.00. Voting Aye: Piva, Zoucha, DeCock, Piva. Motion carried.
A motion by Piva, seconded by Zoucha, to not amend Ordinance No. 467, to not allow car covers on unlicensed or junk vehicles and to keep the mapping boundaries the same as WCNDD presented at the January meeting. Voting Aye: Piva, Zoucha, DeCock, Birkel. Motion carried.
Fraternal Order of Eagles requested a Special Designated Liquor License for April 3, 2021, at the City Auditorium for the Pheasants Forever Auction/Banquet. Motion by DeCock, seconded by Birkel, to approve the application and to waive the occupation tax fee. Voting Aye: DeCock, Birkel, Zoucha, Piva. Motion carried.
Judy Soule requested a Livestock Permit for a llama at 215 West Ave J, from April 1 to October 31, 2021. Motion by DeCock, seconded by Zoucha, to approve the permit. Voting Aye: DeCock, Zoucha, Piva, Birkel. Motion carried.
A motion by DeCock, seconded by Birkel, to approve building permits for Gene Hohl and Randy Stanczyk. Voting Aye: DeCock, Birkel, Piva, Zoucha. Motion carried.
Attorney Robinson-Boone discussed with the Council concerns about keeping store frontage proportionate to all other buildings in the downtown commercial, and also to determine what part of the downtown commercial district is to be included in the discussions. Administrator Campbell will schedule a Planning Commission meeting to discuss said concerns.
Clerk Brown presented the Mayor and Council ACE’s member distribution check in the amount of $7,946.00. Oshkosh is third in 33 communities with its citizens choosing ACE as their natural gas supplier.
A motion by DeCock, seconded by Zoucha, to adjourn the meeting at 6:21 p.m. Voting Aye: DeCock, Zoucha, Piva, Birkel. Motion carried.
