The City of Oshkosh Mayor and City Council met for regular session on July 8, 2021 at 5:00 p.m.
In compliance with the Open Meetings Act of Nebraska, a current copy of the act is posted in the Council Chambers. Notice of this meeting was advertised in the Garden County News and posted at the Oshkosh Post Office, City Hall and Courthouse. The agenda for this meeting was kept current and available for inspection at City Hall.
Mayor Davis called the meeting to order and read the Open Meetings Act, LV 898.
Present were: Mayor Terry Davis, Council Members: Gary DeCock, Mike Piva, Cole Birkel. Absent: George Zoucha. Also attending: Administrator, Bill Campbell, Attorney, Mary Kay Robinson-Boone, Clerk, LeAnn Brown.
Motion by DeCock, seconded by Birkel, to approve the agenda, approve the minutes of the previous meetings and to waive the reading thereof. Motion carried unanimously.

League Association of Risk Management
2021-22 Renewal Resolution
RESOLUTION NO. 13-21
WHEREAS, The City of Oshkosh is a member of the League Association of Risk Management (LARM);
WHEREAS, section 8.10 of the lnterlocal Agreement for the Establishment and Operation of the League Association of Risk Management provides that a member may voluntarily terminate its participation in LARM by written notice of termination given to LARM and the Nebraska
Director of Insurance at least 90 days prior to the desired termination given to and that member may agree to extend the required termination notice beyond 90 days in order to realize reduced excess coverage costs, stability of contribution rates and efficiency in operation of LARM; and
WHEREAS, the Board of Directors of LARM has adopted a plan to provide contribution credits in consideration of certain agreements by members of LARM as provided in the attached letter.
BE IT RESOLVED that the governing body of The City of Oshkosh, Nebraska, in consideration of the contribution credits provided under the LARM Board’s plan, agrees to:
Provide written notice of termination at least 180 days prior to the desired termination date, which date shall be no sooner than September 30, 2024. (180 day and 3-year commitment; 5% discount)

DECLARATION OF NUISANCE PROPERTIES
The City Council of the City of Oshkosh (hereinafter the City), in regular session assembled at the City Hall in Oshkosh, Nebraska on this 8th day of July, 2021, hereby resolves as follows:
WHEREAS, The City of Oshkosh desires to declare Nuisances pursuant to the City Code of Ordinances (Nuisance Ordinance 467).
NOW THEREFORE:
BE IT RESOLVED that the following property located within the nuisance jurisdiction of the City of Oshkosh, Nebraska has been submitted to the City Council at its regular meeting on July 8th, 2021;
2021 OSH 007 – 204 W Ave D, Oshkosh, NE; and
BE IT FURTHER RESOLVED, that the City Council found the following property is declared to have nuisances upon it contrary to Oshkosh City Code of Ordinances and that said nuisance is ratified by this resolution: 2021 OSH 007 – 204 W Ave D, Oshkosh, NE
BE IT FINALLY RESOLVED, that the City shall proceed as determined under the administrative procedure of Article 3(A).

Rescinding Resolution No. 12-21
Rescinding Resolution No. 09-21
WHEREAS, the City of Oshkosh (hereinafter the City) is engaged in a Nuisance Abatement Process; and
WHEREAS, the City appointed West Central Nebraska Development District (WCNDD) as Nuisance Officer; and
WHEREAS, WCNDD identified and confirmed that in its opinion a nuisance exists as defined by Federal, State, City law; and City Council, at a regular meeting, identified nuisance property, supported by evidence; and
WHEREAS, WCNDD now has evidence that the nuisance violation declared in Resolution No. 12-21 and Resolution No. 09-21 which is abated and the properties cleared of nuisances.
NOW THEREFORE, BE IT RESOLVED, that the City of Oshkosh rescinds Resolution No. 12-21 on the following property: CASE NO. 2021 OSH 020 – 207 W Ave B, Oshkosh, NE and
Resolution No. 09-21 on the following property: CASE NO. 2021 OSH 042 – 106 E Ave C, Oshkosh, NE
